Terms of Service

1. Who we are and what these terms cover

Fan Relay is a fan community platform that connects fans with the official pages of musicians, comedians, and content creators (“Entertainers”). The platform is operated by Brilliant Empire LLC and Fan Relay LLC (together, “Fan Relay,” “we,” “us,” or “our”), located at 539 W Commerce St, Dallas, TX 75208.

These Terms of Service (the “Terms”) govern your access to and use of the Fan Relay websites, applications, and services (the “Service”). By creating an account, joining an Entertainer’s community, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may use the Service only with the consent and involvement of a parent or legal guardian who agrees to these Terms on your behalf. We may require proof of age or parental consent and may suspend accounts that do not meet these requirements.

3. Your account

You need an account to access most features. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account. We may refuse, suspend, or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service, other fans, or Entertainers.

4. Memberships, tiers, and points

The Service may recognize levels of fan participation (such as “New Fan,” “Official Fan,” and “Superfan”) and may award points for participating in approved activities, such as answering polls, submitting questions, RSVPing to events, or requesting a tour city.

  • Points and tier status have no monetary value, are not property, cannot be sold, transferred, exchanged, or redeemed for cash, and may be adjusted, capped, expired, or reset at any time.
  • Tier status, points, and membership do not guarantee tickets, admission to events, presale success, merchandise, meet-and-greets, travel, responses from an Entertainer, or any other benefit unless expressly stated in a specific written offer.
  • We may modify how points are earned, what tiers exist, and what benefits are associated with them at any time.

5. Rewards and exclusive content

Entertainers may offer rewards, early access, presale registrations, or tier-restricted content through the Service. Rewards are subject to availability, may carry their own terms, expiration dates, or redemption limits, and may be changed or withdrawn. Access to tier-restricted content depends on your tier at the time of access. Purchases of tickets or merchandise, where offered, are processed by third parties under their own terms.

6. Events, RSVPs, and tickets

Event listings, dates, venues, and access levels are provided by Entertainers and their teams and may change or be canceled at any time. An RSVP expresses interest and is not a ticket, reservation, or guarantee of entry. Ticket sales, where linked, are handled by third-party ticketing providers under their own terms and policies. We are not responsible for third-party ticketing, event cancellations, or venue policies.

7. The Relay and your submissions

The Relay is a feed of official content published by Entertainers and their authorized teams. Depending on the post, you may be able to react, save, share, vote in polls, RSVP, request a city, or submit private questions.

When you submit content to the Service (for example, a question, poll response, or city request), you grant Brilliant Empire LLC, Fan Relay LLC, and the relevant Entertainer a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that submission in connection with operating and improving the Service (for example, showing an Entertainer the questions fans submitted). You represent that your submissions are yours and do not violate any law or the rights of others. Private questions are shared with the Entertainer’s team and are not guaranteed a response.

8. Acceptable use

You agree not to:

  • harass, threaten, impersonate, or harm Entertainers, their teams, or other fans;
  • submit content that is unlawful, hateful, obscene, deceptive, or infringing;
  • access or attempt to access accounts, data, or areas of the Service you are not authorized to use;
  • scrape, copy, redistribute, or rehost content from the Service without permission;
  • use bots, scripts, or other automated means to earn points, vote in polls, or manipulate community features;
  • interfere with the operation or security of the Service, or use it to send spam or unsolicited communications.

We may remove content, revoke points, restrict features, or suspend or terminate accounts for violations of this section.

9. Intellectual property

The Service — including its design, software, text, graphics, and logos — is owned by Brilliant Empire LLC and Fan Relay LLC or their licensors and is protected by intellectual-property laws. Entertainer names, images, music, performances, and other content remain the property of the respective Entertainers or their rights holders. These Terms do not grant you any right to use our or any Entertainer’s trademarks, content, or branding outside the Service. You may use the Service for personal, non-commercial purposes only.

10. Third-party platforms and links

The Service may link to or preview content hosted on third-party platforms (such as Instagram, TikTok, YouTube, or Spotify) and may link to third-party sites for tickets, merchandise, or other offerings. Those platforms and sites are governed by their own terms and privacy policies. We do not control and are not responsible for third-party content, products, or services.

11. Communications

We send transactional emails related to your account (such as sign-in links and password resets). Where offered, you may opt in to notifications about Entertainers you follow by email, SMS, or in-app channels. You can opt out of non-essential communications at any time through your account settings or the unsubscribe mechanisms provided. Message and data rates may apply to SMS.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy. As noted in the Service, information you provide when joining an Entertainer’s community may be shared with that Entertainer and their authorized team so they can operate their fan community.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT, EVENT, REWARD, OR BENEFIT WILL BE AVAILABLE, ACCURATE, OR DELIVERED.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRILLIANT EMPIRE LLC, FAN RELAY LLC, AND THEIR OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR POINTS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless Brilliant Empire LLC, Fan Relay LLC, and the Entertainers whose communities you join from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your submissions, your use of the Service, or your violation of these Terms or applicable law.

16. Suspension and termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or to protect the Service, fans, or Entertainers. Upon termination, your points and tier status are forfeited. Sections that by their nature should survive termination (including Sections 7, 9, and 13–18) will survive.

17. Changes to the Service or these Terms

We are continuously improving the Service and may add, change, or remove features at any time. We may also update these Terms from time to time. If we make material changes, we will provide notice (for example, by posting the updated Terms with a new “Last updated” date or by notifying you in the Service). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction and venue there. To the extent permitted by law, each party waives any right to a jury trial and agrees that claims may be brought only on an individual basis, not as part of a class or representative action.
